  中新社北京4月30日电 (记者 张素)中国最高人民检察院4月30日对外发布一批检察机关依法维护劳动者合法权益典型案例,包括依法惩治恶意欠薪等内容。今年一季度,检察环节共追讨欠薪2700余万元(人民币,下同)。

  最高检有关部门负责人称,检察机关通过提前介入、引导取证、强化立案监督等方式,聚焦打击“以转移财产、逃匿等方法逃避支付劳动者报酬”等恶意欠薪行为,有效发挥刑罚的惩治和震慑作用。

  今年1月至3月,全国检察机关对情节恶劣、后果严重,经责令支付仍拒不支付的犯罪嫌疑人依法批准逮捕260件、264人,依法受理审查起诉拒不支付劳动报酬犯罪799件、936人,依法提起公诉222件、240人。

  此外,检察机关全力做好追赃挽损工作。今年1月至3月,检察环节共追讨欠薪2700余万元。

  在最高检此次发布的“谢某实拒不支付劳动报酬案”中,谢某实组织农民工施工,后拖欠23名农民工工资共计45万余元,且存在逃匿情形。检察机关依法以拒不支付劳动报酬罪追究其刑事责任,同时促成总承包方垫付全部欠薪,优先保障被拖欠的农民工工资的发放。

  最高检有关部门负责人说,从检察机关受理的大量涉农民工讨薪案件看,农民工特殊工资支付制度并未充分落实,事后处罚效果不佳等问题依然存在。下一步,全国检察机关将进一步做实做优支持起诉工作,持续加强支持农民工讨薪起诉工作。

  这位负责人还说,检察机关注重把握好企业因资金周转困难拖欠劳动报酬与恶意欠薪的界限。对真诚认罪悔罪、尽力足额补救支付劳动报酬的,依法从宽处理。(完)
